Supreme Court Blocks OSHA COVID-19 Mandate

In a 6-3 decision today, the U.S. Supreme Court has blocked the enforcement of OSHA’s emergency temporary standard (ETS) related to COVID-19 Vaccination and Testing in the workplace.  The ETS, which was originally announced in November 2021 and has since faced multiple legal challenges, had established vaccination and testing requirements impacting employers with 100 or more employees.

This decision from the Supreme Court does not impact a separate mandate specifically applicable to medical facilities that take Medicare or Medicaid payments, which remains in place.
